Unfair Dismissal Claims

The number of unfair dismissal claims is increasing.  

Claims that succeed can be very costly, time consuming and often attract unwelcome adverse publicity.

Employers are able to dismiss employees for for a number of potentially fair reasons. However, they must still be able to show that the dismissal was reasonable in all the circumstances, having regard to the size and administrative resources of the employer.

Case law has developed some fairly clear criteria as to what must be done to comply with the overriding duty to act reasonably but expert advice should always be sought as the facts of every case can differ enormously.
